The New Food Waste Legislation: What Hospitality Leaders Need to Know

Food Waste Legislation – As the hospitality industry approaches a significant regulatory change, the ‘Simpler Recycling’ legislation under the Environment Act 2021 mandates a new approach to waste management. From 31 March 2025, businesses with 10 or more employees must separate food waste from general and dry mixed recyclables before collection. This initiative has raised concerns, with a hefty 93% of hospitality leaders worried about its impact on their operations.

Industry Readiness and Concerns

Despite the impending legislation, a notable portion of the industry is unprepared, with two-thirds of businesses not yet separating food from general waste, according to the Rubbermaid Commercial Products (RCP) survey. While 88% of businesses separate some recyclables, only 34% handle food waste specifically. This discrepancy highlights a critical need for businesses to adjust their waste management practices urgently.

Larger businesses are particularly worried about the short timescales for implementing changes, the associated costs, and a lack of necessary information. Smaller enterprises express concerns primarily about the financial burden of compliance.

Capcon’s Proactive Approach

Marcus Jones, Managing Director of Capcon, advises businesses to view these changes as an opportunity to enhance their operational sustainability and not just a regulatory hurdle. “By integrating efficient waste management systems, businesses can significantly reduce their operational costs while boosting their sustainability credentials,” says Jones.

Capcon is at the forefront, assisting businesses through consultations and implementations of waste management systems that comply with new regulations while improving overall efficiency.

Strategic Implementation

For successful adaptation, businesses must:

  • Develop and maintain clear waste management policies.
  • Educate and engage staff about new procedures to ensure smooth implementation.
  • Keep accurate records of waste management to comply with legislative requirements and aid in dispute resolution.
  • Review and adjust contracts and policies related to waste management to ensure they align with the new law.
